General Terms and Conditions (T&C)
Important Legal Note: This English version is a "convenience translation" intended solely for information purposes. In the event of any discrepancies or disputes, the German version ("Allgemeine Geschäftsbedingungen") shall prevail and be legally binding.
1. Scope of Application
These Terms and Conditions apply to all contracts between Marc Abernathy (hereinafter "Contractor") and the client (hereinafter "Client"). They apply to both consumers and business entities (e.g., universities, research institutes).
2. Scope of Services
(1) The subject of the contract is the provision of consulting, editing, or workshop services.
(2) Nature of Service: The Contractor owes the provision of the service (Service Contract), not a specific result. The Contractor specifically does not guarantee the acceptance of manuscripts, the approval of grant proposals, or specific grades/evaluations.
3. Payment
Invoices are due for payment immediately upon receipt without deduction, unless agreed otherwise.
4. Cancellation Policy
(1) For 1:1 Coaching/Consulting: Appointments may be cancelled free of charge up to 24 hours in advance. Cancellations made later than this will be charged at the full rate.
(2) For Workshops/Talks:

Up to 4 weeks before the date: Free of charge.

Up to 2 weeks before the date: 50% of the fee.

Less than 2 weeks before the date: 100% of the fee.
(3) Any non-refundable travel expenses already incurred must be reimbursed by the Client.
5. Liability
(1) The Contractor is liable without limitation for intent and gross negligence.
(2) In cases of slight negligence, liability is limited to the breach of essential contractual obligations and is capped at the foreseeable damage typical for this type of contract.
(3) The Contractor assumes no liability for the factual accuracy or scientific validity of the content discussed. The scientific responsibility remains solely with the Client.
6. Copyright
All workshop materials, presentations, and concepts provided are protected by copyright. They are intended solely for the personal use of the participants. Reproduction or distribution to third parties is not permitted without written consent.
7. Governing Law
German law applies.
